VIDEO: Regulation of Biocides in UK - an update from the Health and Safety Executive (HSE)

The Chemicals Regulation Division (CRD) within HSE regulates pesticides, biocides, industrial and consumer chemicals, detergents and the export and import of dangerous chemicals.

The key pieces of legislation involved are:

  • The Plant Protection Products (PPP) Regulations, including Maximum Residue Levels (MRLs)
  • The Biocidal Products Regulation (BPR) Regulation
  • Registration, Evaluation, Authorisation & restriction of Chemicals (REACH) Regulation
  • The Classification Labelling & Packaging (CLP) Regulation
  • The Prior Informed Consent (PIC) Regulation (the latter relates to export and import of certain hazardous chemicals to non-EU countries).

Before any biocide product can be used, sold, supplied or stored it must be authorised for use. These authorisations are granted by the Chemicals Regulation Division (CRD) on behalf of Ministers.

To authorise these products, CRD conducts scientific assessments and evaluations while making regulatory decisions and contributing to discussions on the development of regulatory schemes. In doing this, we seek to prevent any adverse effects of chemicals on people and the environment.

From 1 January 2021, in Great Britain (England, Scotland and Wales) a new independent biocides regulatory regime has been in operation. Great Britain (GB) will take responsibility for our own decisions using our own rules. Northern Ireland continues to follow EU. HSE continues to be the competent authority for UK.

This session will outline the new GB regulations and how they are being implemented. In this, HSE will outline the requirements for both GB and Northern Ireland (NI) and actions that businesses should be aware of to keep biocidal products on the market.
